What Law 25 means for your website hosting

Since September 2023, every business that collects personal information from people in Québec must comply with the Act respecting the protection of personal information in the private sector, better known as Law 25. Where are Ex2’s servers located?

Is Ex2 really a Canadian company?

Yes. Ex2 Inc. is registered in Québec and headquartered at 797 Lebourgneuf Boulevard in Québec City. Our terms are governed by the laws of Québec and the federal laws of Canada.

Does hosting in Canada make my website compliant with Law 25?

Hosting is one piece of compliance, not all of it. Storing personal information in Canada removes the need to assess a transfer outside Québec, which is one of Law 25’s requirements. You still need a privacy policy, a designated person in charge, consent for data collection and an incident log. Hosting in Canada makes the data-location part simple.

What is the difference between Law 25 and PIPEDA?

PIPEDA is Canada’s federal private-sector privacy law. Law 25 is Québec’s, and it goes further: mandatory privacy impact assessments before sending data outside Québec, a named privacy officer, and administrative penalties of up to $10 million or 2% of worldwide turnover. If you serve customers in Québec, both apply to you.

Is my data subject to the US CLOUD Act if I host with Ex2?

When you choose the Canadian data centre, your data is stored in Canada by a Canadian company. Ex2 Inc. is not a US entity, so we are not subject to US orders under the CLOUD Act the way a US-headquartered host would be.

Do I need a .CA domain to host in Canada?

No, you can host any domain with us. A .CA simply tells your customers you are Canadian, and it is free the first year with an annual or longer hosting plan.

Can you move my site from a host outside Canada?
