What Québec’s Law 25 means for your website hosting

Law 25 covers businesses that collect personal information from people in Québec, not only businesses based there: if you sell to customers in Québec from Ontario or BC, it can apply to you too. Most of its rules have been in force since September 2023, and your contact forms, customer accounts, newsletters and online orders all count. Its first question is simple: where is the data?

Is Ex2 really a Canadian company?

Yes. Ex2 Inc. is registered in Québec and headquartered at 797 Lebourgneuf Boulevard in Québec City. Our terms are governed by the laws of Québec and the federal laws of Canada.

Does hosting in Canada make my website compliant with Law 25?

Hosting is one piece of compliance, not all of it. Keeping personal information in Canada, with a Canadian company, makes the assessment Law 25 requires before data leaves Québec much simpler than sending it to another country. You still need a privacy policy, a designated person in charge, consent for data collection and an incident log.

What is the difference between PIPEDA and Law 25?

PIPEDA is Canada’s federal private-sector privacy law. Law 25 is Québec’s, and it goes further: privacy impact assessments before data leaves Québec, a named person in charge of privacy, and administrative penalties of up to $10 million or 2% of worldwide turnover. If you serve customers in Québec, both can apply to you.

Is my data subject to the US CLOUD Act if I host with Ex2?

Ex2 Inc. is a Canadian company, not a US entity. When you choose the Canadian data centre, your data is stored in Canada by a company under Canadian law. A US-headquartered host, by contrast, can be compelled under the CLOUD Act to hand over data it controls, wherever that data is stored.

Do I need a .CA domain to host in Canada?

No, you can host any domain with us. A .CA simply tells your customers you are Canadian, and it is free the first year with an annual or longer hosting plan.
